Back to School Promotion Terms and Conditions

1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. The Back to School – win back your requirements list competition (“Promotion”) is operated by Winc Australia Pty Limited (ABN 94 000 728 398) of 163 O’Riordan Street, Mascot NSW 2020 (“Promoter” or “Winc”).

3. The Promotion commences at 12:01am AEDT on 23 September 2019 and ends at 11:59pm AEDT on 31 December 2019 (“Promotional Period”), unless terminated, modified or suspended earlier at the sole discretion of Winc.

4. You agree to these Terms and Conditions of the Promotion by submitting your entry for the Promotion. Entries must comply with these conditions to be valid. Information on how to enter the Promotion forms part of these conditions of entry.

5. Entry is open to Australian residents who are parents or guardians of school-aged children and who purchase their child’s back to school requirements through officemaxschools.com.au during the Promotional Period (“Eligible Purchase”). Parents must have children who are enrolled in an eligible school in Australia. For the removal of doubt, both public school parents/guardians and private school parents/guardians are eligible to enter the promotion so long as their child’s school is registered with the respective school registration authority in each state or territory.

6. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

7. Entry is automatic with an Eligible Purchase. Multiple entries are not permitted. Prizes in this Promotion will be awarded to twenty individual Australian parents.

8. Winners will be selected via a random prize draw at 10:00AM AEDT (“Prize Selection Date”) on 13/01/2020 at 163 O’Riordan Street, Mascot NSW 2020.

9. A total of twenty individual winners will be selected and each winner will receive a total of $150 to cover the entirety or a portion of their children’s school requirements. The prize will be paid directly to each winner via EFT. For payment to be made, each winner must supply their bank details as well as either a deposit slip or bank statement. A limit of one prize per family applies.

10. Once the winning entries have been verified, the winners will be notified via email and/or telephone, using the email address and phone number supplied to the Promoter at the time of entry, within two business days of the Prize Selection Date.

11. If after making reasonable efforts to contact a winner, the winner cannot be contacted or prizes remain unclaimed 30 days after the Prize Selection Date, Winc reserves the right to redraw any unclaimed prizes on 13/02/2020. The winner(s) of the redraw will be notified via email or telephone within two business days of the redraw.

12. Total prize pool value is $3,000.

13. Prizes, or any unused portion of a prize, are not transferable or exchangeable.

14. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

15. The Promoter’s decision is final, and no correspondence will be made about this decision.

16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

17. Any cost associated with accessing the promotional website or sending an email is the entrant’s responsibility and is dependent on the Internet service provider used.

18. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).

19. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

20. The Promoter collects personal information in order to conduct the Promotion. The Promoter may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Some of the parties mentioned above may be located overseas. By entering the Promotion, you acknowledge that the Promoter may for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes. Please refer to the Promoter’s Privacy Policy at www.officemax.winc.com.au/privacy-policy/ for details. The Promoter will also use and handle personal information as set out in that Privacy Policy. You should direct any requests to opt out, access, update or correct personal information to the Promoter and direct any complaints regarding treatment of your personal information according to the Privacy Policy.

21. The parent or guardian entrant:
(a) will ensure that they agree and comply with these Terms and Conditions;
To the extent permitted by law, the parent/ guardian agrees to hold the Promoter harmless from any and all losses or damages arising from this promotion and to indemnify the Promoter against:
(b) any claims made by the entrant, any member of his or her family or any other party, against the Promoter in connection with the Promotion or the entrant's participation in the promotion; and
(c) any losses (including any liability) caused by any act or omission of the entrant which is inconsistent with these Terms and Conditions.

22. These Terms & Conditions will bind this and any future entry by you into a competition on this site and may be updated from time to time.
